Terms of Service

1. Platform Overview

Hubby ("the Platform," "we," "us") operates a marketplace that enables customers ("Customers") to request and pay for property maintenance, home improvement, and related services performed by independent service providers ("Service Providers" or "Hubbys"). Hubby is headquartered at 300 3rd Ave SE, Suite 201-03, Rochester, MN 55904.

2. Platform Role & Relationship

• Hubby is not an employer of any Service Provider. All Service Providers are independent contractors who operate their own businesses.
• Hubby does not guarantee the quality, safety, timeliness, legality, or completion of any services performed through the Platform.
• Hubby does not provide tools, equipment, materials, or supplies for any job.
• The contractual relationship for services is directly between the Customer and the Service Provider. Hubby facilitates this connection but is not a party to the service agreement.

3. Limitation of Liability

Hubby shall not be held liable for any damages, injuries, losses, or claims arising from:

• The actions, omissions, negligence, or misconduct of any Service Provider
• The quality, completeness, or workmanship of any services performed
• Property damage occurring during or as a result of services
• Personal injury to any party during service delivery
• Theft, loss, or damage to personal property
• Any disputes between Customers and Service Providers

The Platform is provided on an "as is" and "as available" basis without warranties of any kind.

4. Service Provider Obligations

By registering as a Service Provider, you represent and agree that:

• You are an independent contractor and not an employee of Hubby
• You are solely responsible for the quality and safety of services you perform
• You carry appropriate general liability insurance (minimum $500,000; required for commercial)
• You hold all necessary licenses, permits, and certifications
• You are responsible for your own taxes including self-employment tax
• You consent to a background check as part of the application process

5. Payment Terms

• Payment is authorized and held securely at the time of booking
• Funds are not released to the Service Provider until the Customer confirms the work is complete
• A service fee of 10% is applied to each transaction
• Pricing is based on details provided at booking and may be adjusted with customer approval if scope changes

6. Cancellation Policy

• Before Hubby accepts: Full refund
• After acceptance, 24+ hrs notice: Full refund
• Same-day cancellation: May incur $5 fee
• After work begins: Case-by-case resolution

7. Insurance & Indemnification

Service Providers are required to maintain general liability insurance. You agree to indemnify, defend, and hold harmless Hubby from any claims arising from your use of the Platform, services performed or received, or violation of these Terms.

8. Background Checks

Hubby conducts background checks on Service Provider applicants. However, background checks have inherent limitations. A passed background check does not constitute an endorsement or guarantee of a provider's character, skills, or reliability.

9. Dispute Resolution

Any disputes shall be resolved through binding arbitration in Rochester, Minnesota. Both parties waive the right to a jury trial and the right to participate in a class action.

10. Governing Law

These Terms shall be governed by the laws of the State of Minnesota.
